Question: ?I am a doctor. My patient was injured on the job and his workers? compensation insurance paid for a little while. Now they have been denying bills after ?utilization review?. The patient?s attorney isn?t doing anything to get the bills paid. Can I go after the workers? compensation insurance company myself to get paid?

Answer:? Yes.?Medical providers have a right to file a petition for compensation due in any case where payment of medical bills is being contested. The issue is addressed several times in Title 19 of the Delaware Code. ?For example, Title 19 Del.C. ? 2346 provides:

If any person charged with the payment of medical and other services and the provider to whom said payment is due fail to reach an agreement in regard to such charges, any interested party may notify the Department of the facts. The Department shall thereupon notice the time and place of hearing sent by certified mail to all parties in interest.?

Also, 19 Del.C. ? 2348(b) states as follows:

(b) In a controversy as to the responsibility of an employer or the employer?s insurance carrier for the payment of compensation and other benefits under Part II of this title [Part II includes medicals], any party in interest may petition the Board in writing for a hearing and award. The petition shall be sent to the Department?s offices in Wilmington and shall set forth the reason for requesting the hearing and questions in dispute which the applicant expects to be resolved.

There is a 45 day rule for appeals from Utilization Review denials, but there is also a Superior Court case invalidating that rule because it conflicts with the 2 year/5 year statute of limitations on workers? compensation claims found in the Delaware Code. ?The case dealing with that issue was Avila-Hernandez, C.A. No. N10A-06-002 DCS (Jan. 6, 2012).?(Please note: Avila-Hernandez is currently on appeal in the Delaware Supreme Court. As of the time of this blog post, en banc oral argument is scheduled for November 14, 2012 at 2 pm.)

Even wider blackouts sweep India for second day

NEW DELHI (Reuters) - Grid failure hit India for a second day on Tuesday, cutting power to hundreds of millions of people in the populous northern and eastern states including the capital Delhi and major cities such as Kolkata.

The government said the northern, eastern and northeastern grids were hit, wider than Monday's blackouts.

Delhi's metro system ground to a halt and office buildings ran on backup generators a day after a 12-hour blackout caused commuter chaos in the bustling capital, underscoring overstretched infrastructure that has weighed heavily on India's economy.

"The northern grid has failed again," Arvinder Singh Bakshi, the chairman of the Central Electricity Authority, told Reuters.

The northern grid alone covers more than 300 million people from the mountains of Himachal Pradesh to the Ganges plains in Uttar Pradesh, which has a larger population than Brazil.

TV stations said the eastern grid was also affected and a Reuters reporter said some areas of the former capital Kolkata in the east of the country were without power.

Colo. victims tweets give insight on life, death

For Jessica Ghawi and Alex Sullivan, life's final minutes were about anticipation ? not for anything life-altering, just a few hours of entertainment.

But their thoughts, as shared through tweets from two of the 12 killed in Friday's early-morning mass shooting at a movie theater in Aurora, Colo., have become a focal point for thousands of Americans openly contemplating a fundamental curiosity: For people about to die, what are the last moments in this world like?

Such minutes have typically been intimate, once reserved for one's own confidantes or, at least, a select few who might be nearby. But as Twitter and other social networks become real-time databases of human thought and interaction, the unfiltered conclusions of some human lifetimes are being cast into the public sphere for the entire world to see.

Among the billions of posts made each day on social nets, users regularly gravitate toward final postings by celebrities and others who have died. The Aurora victims have become the most recent example.

Sullivan was celebrating his 27th birthday at the start of a weekend when he planned to also mark his first anniversary with his wife, Cassie. He tweeted shortly before the movie: "(hash)TheDarkKnightRises (at)Reel_Nerds oh man one hour till the movie and its going to be the best BIRTHDAY ever."

Once his death became public, the tweet morphed into a springboard for a steady stream of people noting its significance and sharing sentiments. As new tweets rolled in, they came from different people but many comments were universal; things like: "RIP," ''So sad. Last tweet," or teary emoticons.

For Ghawi, a 24-year-old aspiring sportscaster who worked under the name Jessica Redfield, the public words in those last minutes are her bantering with a magazine hockey writer about being among the first to see the highly anticipated Batman movie, "The Dark Knight Rises."

"You aren't seeing it tonight?!" Ghawi asks Sporting News hockey writer Jesse Spector on Twitter.

"Nope," he replies.

Ghawi then jokes that Spector is a loser, and he retorts that that's why she's tweeting and not at the movie. Ghawi replies with her final tweet, in all caps: "MOVIE DOESN'T START FOR 20 MINUTES." It was, though she of course didn't realize it, her last public statement.

But as it was retweeted and favorited thousands of times and cited by reporters worldwide to help piece together portraits of her personality, it also, in a way that wasn't possible a few years ago, connected her to countless people seeking to know her as more than a victim of one of the worst mass shootings in American history.

The unknowing candor shown by Ghawi and Sullivan make the glimpses they gave us even more honest. It underscores that few of us know when death will arrive. And in a world where social media has become so deeply ingrained in our shared culture so quickly, we also have little control over which random slice of life might serve as our final exclamation.

Anyone who's used social networks knows they've revolutionized the way we communicate. But few sign up for accounts thinking they can change how we think about life and death.

"I hate that this was a last tweet," tweeted Brad Kovach, a 22-year-old computer science student at the University of Wyoming, in response to Ghawi's last tweet.

Kovach said in an interview that the exchange gives us a joyous snapshot of Ghawi, but probably not the goodbye Ghawi would have picked if she knew she was speaking to the world for the last time.

But he acknowledged being uncertain about what's a fitting final tweet.

"I'm thinking if that was me, I wouldn't want that (message) to be me. At the same time, I kind of do, I just want it to be a very positive expression," Kovach said. "Hopefully, your life doesn't end in tragedy and I guess there's no preparing for that."

For Spector, who ribbed Ghawi once more after her final tweet before the horror unfolded, her last statement is haunting. "It's impossible to comprehend, and worse because Jessica isn't here to tweet the right thing," Spector wrote in a column hours after her death.

Roberta Cohen, a grief specialist who runs a firm that responds to traumatic events all over Texas, said people who generally don't think about their own deaths are jolted by occurrences like the Colorado shooting because they can relate to the victims and what they were doing before they died.

"An event like this breaks through that denial and gets us to look at life-and-death questions," Cohen said.

Even if they're not profound statements, people are touched by final comments, more than they are moved by deliberately reflective, insightful statements made in times when nothing significantly changes afterward, she said.

Twitter and other social networks make it easier for those comments to spread quickly. For some, tweets by those killed ? retweeted and appended by others, are the first time they put a name to who died.

"It's a pretty amazing concept that we can see what people are thinking just moments ago, and moments later their lives change," Cohen said.

It has happened before, most notably with the famous.

?Andrew Breitbart, the conservative blogger and publisher who died in March after collapsing while walking near his home, used his last tweet to apologize to a follower for calling him a "putz."

?Dr. Frank Ryan, a well-known plastic surgeon from Beverly Hills, veered off a cliff in 2010 just minutes after tweeting a picture of his dog looking out toward the ocean from a sand dune.

?Heavy D's final tweet late last year became as memorable as his rap hits when he wrote simply: "BE INSPIRED."

It goes beyond postings from the famous and highly publicized, though. Months of Facebook updates by a mother who died soon after giving birth to a son resulted in a memorable 2010 Washington Post story told through her posts. Her final post, less than 12 hours before she died, told of her fear at being transferred to another hospital for more evaluation and testing.

These glimpses, pecked away by fingers or thumbs in fleeting moments and amplified only when their significance becomes known, are spurring people to more publicly share spontaneous thoughts about moments of life and death. All it took here to open the floodgates were a couple 140-character messages, and the knowledge that the people who wrote them had died ? mere moments or hours ago ? in a very public tragedy.

Those brief glimpses still don't give us firm answers. But that's not quite the point.

"It really kind of intensified my whole emotional response to the whole tragedy," Kovach said. "It definitely just reminds us that even if our only common thread is that we both have a Twitter account, we're still humans and we're in this together."

Political wrangling leaves Gaza patients stranded

(AP) ? A dispute between rival Palestinian governments is preventing scores of Gaza patients from receiving urgent medical care abroad, officials said Sunday.

Israel and Egypt restricted movement in and out of Gaza after Hamas seized the territory from Palestinian President Mahmoud Abbas in 2007, leaving him with parts of the West Bank.

Gaza offers only basic medical care, and patients seeking treatment abroad need to get a referral from a medical committee there before they can cross into Israel or Egypt. The committee technically reports to the West Bank government, but operates with the tacit support of the Hamas authorities in Gaza.

Last week, the West Bank's health minister appointed a new board, replacing one that was appointed in 2009. After that decision, the medical committee stopped working, and patients could no longer get referrals.

Omar Nasser, a spokesman for the Health Ministry in the West Bank, said Hamas police entered the offices of the committee and expelled those working there after the new committee was appointed. Ashraf al-Kidra, a spokesman for the Health Ministry in Gaza, denied that security forces raided the committee offices. He said local employees refused to work with the newly appointed committee members.

Iyad al-Alami of the Gaza-based Palestinian Center for Human Rights said the political wrangling is hurting innocent patients.

Israeli officials said they have not received any requests from the Gaza committee for transferring patients since Wednesday.

LOS ANGELES - Actor Christian Bale, who plays Batman in "The Dark Knight Rises," expressed horror and grief for the victims of Friday's shooting spree that left 12 dead in a Colorado theater at a midnight showing of his new movie.?

"Words cannot express the horror that I feel," he said in a statement released on Saturday by his spokeswoman, Jennifer Allen. "I cannot begin to truly understand the pain and grief of the victims and their loved ones, but my heart goes out to them."?

James Eagan Holmes, 24, is in police custody and accused of the crime in which 58 others were injured. Holmes also is accused of booby-trapping his apartment in the Denver suburb of Aurora, Colorado, before the rampage.?

Am I Cheating? Fidelity and Online Dating ? Articles about love ...

Online dating is one of the fastest growing industries in the UK today. Every day, hundreds of thousands of us log on to one or more of the growing number of sites available; some looking for serious relationships, others for friendship and companions, and still others for casual flings and that extra ?bit on the side?.

Some sites claim to be purely for genuine singles seeking committed, long term relationships, others turn a blind eye to, or even actively encourage, married or cohabiting members who may or may not use the sites with the blessing of their spouse or partner. Of course many people who use online dating sites do so purely for chatting and exchanging messages and never meet face to face; with the steady growth of the Internet as a communication tool since it?s inception, it has become increasingly possible for netizens to conduct deeply involved, real time relationships with people they have never actually met.

So what does this change with regard to the old ways of doing things? When does an online relationship become ?intimate?? Can you fall in love with an avatar, and can you cheat on someone, or with someone, who is in a different time zone?

A recent study by Dr Martin Graff of the University of Glamorgan showed that our perceptions of what does and does not constitute ?cheating? online are affected by a variety of factors ? most prominently, and perhaps unsurprisingly, by the level of information dating site users are prepared to disclose about themselves; Dr Graff explains

?From this study, it seems that the greater the level of typed disclosure, then the stronger the perception of infidelity.?

Seemingly, in the absence of the ?nonverbal cues? on which face to face interaction relies so strongly, how much we are prepared to give away about ourselves is the primary indicator of how intimate our online relationships are and by extension, the degree of unfaithfulness inherent in the actions of non single site users.

Perhaps more surprisingly, the study also showed that the time of day at which online encounters took place was also a key factor in establishing infidelity, concluding that

?Exchanges later in the evening were perceived to be more infidelitous, than those which might ?? ?take place in the day or early evening.?

Dr Graff?s study is ongoing and subsequent phases will look at the issues of jealousy and trust in the0020context of online relationships.

Ultimately the jury is still out on exactly what constitutes online infidelity and indeed relationships over the net as a whole. It is doubtful that a firm conclusion will ever be reached as the world of online dating and relationships, as in ?real life?, will always be immensely subjective due to the differing moral standards and emotional responses of the individuals involved. Studies like Dr Graff?s can however provide a fascinating insight into the human causes and effects of the modern world, and how these are shaped by the direction of our rapidly developing and changing communications technology.

Its Budget Sunk, Undersea Lab May Have To Surface

This is SCIENCE FRIDAY. I'm Ira Flatow. Eight miles off the coast of Key Largo, Florida, and 60 feet underwater, you'll find the Aquarius Reef Base, a science lab on the sea floor and the only one left of its kind. It's cozied up to a coral reef. In fact, the lab itself has become part of the reef, covered in living things. And inside that bubble under the sea is my next guest. She spent all week on the ocean floor exploring the reef and observing its residents, like sponges and corals and goliath groupers.

And she's here to tell us what it's like down there in what could be the lab's last mission. Federal funding was cut for the lab. Sylvia Earle is an oceanographer, chief science adviser for One World One Ocean. She's also explorer-in-residence at National Geographic Society. Welcome back, Sylvia.

SYLVIA EARLE: Well, hello, Ira. Nice to be back onboard.

FLATOW: Thank you. Tell us what you're doing down there.

EARLE: We are really enjoying the opportunity to explore this reef, continuing what scientists have been doing here for about 20 years, getting a great record of the nature of Conch Reef. It's like a microcosm that enables scientists and others to really understand what's happening to reefs around the world. It's generally not good news. You know, reefs have been in great decline since I was a child. Having an underwater laboratory where people can come and spend hours, days, weeks underwater, is such a gift.

Some of my fellow aquanauts here, Mark Patterson in - from Virginia Institute of Marine Science, College of William and Mary, and Dale Stokes from Scripps Institution of Oceanography and explorer and filmmaker D.J. Roller, we're working together to document questions about ocean acidification, looking at the feeding behavior of a giant fish that lives in this area that was in serious trouble but has been protected and is beginning to come back, the goliath grouper.

It has a wonderful way of feeding, opening its mouth and in so doing creating a bubble of air and water vapor that collapses. And it creates a sound that you can feel, a giant whumph, and in so doing, it sucks in the prey. And being able to document that on film, to observe it, is really part of our mission here.

FLATOW: Mm-hmm. And I understand that the reef - the laboratory has lost its funding. Is that correct, and it's going away?

EARLE: Well, this marks the 50th anniversary of work that began in 1962 with Jacques Cousteau in Florida, Ed Link and his colleagues, just showing that people can breathe compressed air or exotic mixes of gases and extend the time they can spend underwater. Navies around the world, including our own, industry has adopted this technique. It's used widely in the oil and gas industry to extend the time people can spend at depths, sometimes more than 1,000 feet underwater.

But here we are at 20 meters and spending, in this case, a week. It's proven itself to be valuable time and again. But yes, you're right on, that for whatever reasons, this $3 million project is being zeroed out, along with the entire National Underwater Research Program that includes two little submarines that are out at the University of Hawaii in - and where they can go to 2,000 meters. They're the deepest diving subs available as assets to this country now that Alvin, at least for the time being, is being renovated, currently out of commission.

But we hope to see him back in commission to be able to go to 6,000 meters beneath the ocean. But, you know, the efforts to enable people, not just instruments but human beings, to have access to the sea, they're uncommon at best, and yet they're proven as an approach that, just as it's been invaluable to have astronauts up in the sky, taking that wonderful computer that we call the human brain on the scene, having people actually in the water observing, documenting, using the ocean as a laboratory, it's invaluable. There's nothing that can substitute for the human presence.

FLATOW: Mm-hmm. Tell us what a typical day like - like is down there. You get up. You eat breakfast. You look at the fish. What do you do in a laboratory down there?

EARLE: Well, the great thing is you have freedom to use the ocean as a laboratory. And you can be up early and you can stay up late. You can go spy on the fish and the sponges and the corals. The day and night are as different as, well, day and night, you know? You have day fish that are out swimming around that tuck in and sleep at night. At night there's another whole category of life that - even some of the corals are closed up by day. And at night that's when they feed.

And to just look at the - for a short glimpse or for only the daylight hours, we really miss out some of the most important action. The live grouper feeds at night. They rest by day. Presently, there's only one giant grouper that set up housekeeping here at Aquarius. But sometimes there have been as many as six that log in here at the laboratory as their home base and then roam out in varying (technical difficulty)

FLATOW: Yeah. Yeah, well, I guess - are you there, Sylvia?

EARLE: Yes, I'm here.

FLATOW: Good. We never know with the line under the ocean...

(LAUGHTER)

EARLE: I know.

FLATOW: ...is going to be like.

EARLE: Well, we - of course, we have bunks here, and we sleep from time to time. And food, we have a microwave oven. We have a sink. We have a shower (technical difficulty) hot water. You know, it's pretty (technical difficulty)...

FLATOW: Is it light up at all at night when you look outside? Any...

EARLE: Well, we have lights on the laboratory that illuminate a little - individual places. But, of course, it's - the great thing about being out at night is you can see the moon when the moon is full. I've been underwater 50 feet down and actually been able to see stars...

FLATOW: No kidding.

EARLE: ...through 50 feet of water. Yeah.

FLATOW: No kidding.

EARLE: And you can watch the sun come up. I tend to get up early, and it's great to be inside and watch the change from just pitch black to that first light. Now, we don't actually see the sun come up, but we see the change in light, and with it comes a change in the kinds of creatures who swarm around the windows are up and around.

FLATOW: So Aquarius has become part of the reef itself.

EARLE: It has. It's become embroidered with this tapestry of corals and sponges. I spent a lot of time just last night focused on a - just one small area of Aquarius that had at least a dozen of the major divisions of life on Earth. You'd have a hard time going anywhere on the land and seeing that many divisions or kinds of animal life. But in the ocean it's pretty easy. Nearly all of the major kinds of life, divisions of life, phyla of animals, occur in the sea. Only about half of them can make it to land or freshwater. So it's just an extraordinary opportunity that I hope will be maintained.

There's great concern that because Aquarius, along with the rest of the National Underwater Research Program, has been zeroed out by Congress as of September this year, that we're going to lose this asset, this unique capability of being able to explore the ocean by being in the ocean, using the ocean as a laboratory. And, of course, having submarines that can go deeper than divers can go is another great asset that we shouldn't lose(ph) .

I think of what we're doing is looking at the blue homeland of our country. You know that out 200 miles we have jurisdiction. And we know so little about that blue United States. It's - we're just at that beginning era of exploration of the ocean, generally. But even our own blue backyard is largely a mystery. We know how to destroy it. We know how to take the fish. We're really good at doing that. We've managed to globally and even in the United States eliminate on the order 90 percent of the sharks, swordfish, tunas, you know. We certainly can reduce the quantity and even the diversity of life in the sea.

There used to be monk seals in the Gulf of Mexico, probably right here where we're diving around Aquarius. But in 1952 the last one was seen - we - if - but there are other things like the goliath grouper, like the coral reefs themselves. There is hope, but only if we really understand what we're doing and take action while there's still time.

BRIAN: Hi. How are you doing, Ira?

FLATOW: Hi there.

BRIAN: My question is, are you finding any evidence in the coral reef of a, let's say, last glacial period or any clues to climate change that might help us in the future?

EARLE: Definitely. In work that has been done along this part of the coast and elsewhere in the world, you can actually see old shorelines that have been flooded in the past. Mark Patterson, who's here from the Virginia Institute of Marine Science, is conducting experiments on acidification of the ocean. That is another aspect of climate change, that excess carbon dioxide in the atmosphere is turning to carbonic acid. And in the last 10 years there's been a troublesome - troubling increase, an alarming increase in the pH of the ocean, changing chemistry of the sea. So it's climate change, it's global warming, sea level rise, but it's also changes in chemistry that are of concern, and it's the sort of work that's being looked at here.

Dale Stokes, a physical oceanographer and a scientist at Scripps Institution of Oceanography, has in the past and during this trip as well been looking at the deep currents that flow up from the surrounding area, cold water that washes over. And we experienced some of it last night. You could feel the changes in temperatures as this flow of deep cold water comes up into the reef. It's part of what beings nutrients from deep water.

But it also - so all of this - I think the important thing is the body of knowledge over 20 years, the individual projects, the bits and pieces that together are showing us a pattern. For the first time we're able to understand things that we couldn't when we first began exploring Conch Reef or coral reefs generally.

MITCH: Hi.

FLATOW: Hi there.

MITCH: Can you, Doctor, can you - is that lab designed so that you can get out of it and pressure up and swim around?

EARLE: Oh, my goodness, yes, that's the whole point. We have the best swimming pool in the world. There's a blue hole in the floor. Water is kept from coming inside by pressure, of course, so the outside pressure and the inside pressure are about the same. So we just have access to the sea. That's the joy of being able to live underwater. It's not just to be in a capsule where you stare out the windows. It's more or less what astronauts do, except for their occasional times to do these - as they say, extra-vehicular activity. But here the whole point is to gain time in the ocean. We do spend a lot of time when we're inside staring out the windows, but mostly we're here so that we can actually be out in the ocean and make excursions.

FLATOW: So there's no hatch on that, not even a door. It's just the air pressure that's keeping the water out.

EARLE: That's right. That seems a little (unintelligible).

FLATOW: Wow. I'd love to be there.

(LAUGHTER)

EARLE: Here we are, warm and dry.

FLATOW: All those scuba divers are tweeting us, saying they wish they were down there with you.

EARLE: Oh, I hope they do.

FLATOW: Yeah.

EARLE: We need more of these undersea laboratories. Back in 1970, I really imagined that this would be something that would be so valuable, and people would really understand how important it is to explore the ocean by being in the ocean, to see it from the inside out, actually be able to take sophisticated instruments and put them in the ocean. And as scientists, you know, you're under - your laboratory is there on the reef. They call this the electric reef because instruments can be plugged into the Aquarius, a power source, and monitor the nature of things in a way that - we couldn't do that 50 years ago, 40 years ago, even 30 years ago.

But Aquarius has become a real treasure with a big investment of a lot of people, and it's heartbreaking to see this small investment, $3 million a year, with big returns, just lost. It just doesn't make sense. It's true with the manned submarines too. We just need to have a great and renewed commitment to ocean exploration, research, education and care. That's what should happen on our watch.

FLATOW: Any chance you could get a consortium of universities or whatever to chip in and...

EARLE: Well, actually, a foundation has been established called the Aquarius Foundation that's open for business, open for contributions. And I think it's great, just as a space station is kind of open for business, for private contributions. But it's the legitimate role of government, from national parks, for some of the things that serve all the people, to explore, to give back, to understand how this world works, and that's what Aquarius has been doing. That's what Pisces(ph) out in Hawaii have been doing now for decades. And it's maybe because it's only a program that cost five million instead of five big D billion dollars. If we're big enough in terms of dollars, maybe people would think it's really important. The fact that it costs so little doesn't mean that it is of little importance. It's of enormous importance and...

Why Google, Microsoft Got Into Tablet Business

Google and Microsoft know that the only way their mobile software will gain a significant portion of the tablet market is to design, build, and brand their own tablets. The Nexus 7 is Google's effort to control Android's slide into fragmentation while simultaneously setting a benchmark for price and quality. For Microsoft, the Surface tablets are the end of a three-year initiative to build platforms from the ground up. And the software giant isn't going to leave the final leg to hardware manufacturers.

Both Google and Microsoft have watched the performance of their respective operating systems suffer with underpowered, hastily built hardware. Microsoft learned years ago that a poorly written hardware driver could bring Windows to its knees. More recently, Google watched manufacturers cash in on the iPad craze by churning out one cheap, useless tablet after another. Even K-Mart was selling an Android tablet early on for $149. K-Mart didn't suffer. Android did.

Ontario Farm Real Estate: Home and Farm For Sale ...

BPO | Business Process Outsourcing | HfS Research Blueprint ...

Business Process Outsourcing (BPO) picture of HfS logo homeImproving our industry is the focus of an outsourcing industry blueprint released by HfS Research, the analyst research organization that boasts 120,000 services professionals. The document identifies key issues affecting outsourcing and provides 21 detailed recommendations to improve the industry.

It came together in an intriguing way. Phil Fersht, HfS CEO, brought together many of the outsourcing industry?s key players to share their experiences, challenges, successes and future desires in an open setting. The objective, according to Fersht, was to make a genuine difference in how the industry currently operates. The blueprint identifies four major challenges currently facing industry participants:

  1. Overcoming the singular focus on cost that strips the industry of value.
  2. Leveraging outsourcing as one of a variety of vehicles to achieve business objectives.
  3. The need for service providers to invest smarter in their account management teams.
  4. The need for buyers and providers to partner to foster innovations into business and IT process outcomes.

BancTec?s iBPO Addresses Industry Challenges

BancTec?s Intelligent BPO (iBPO) process addresses the concerns of many BPO clients by moving beyond mere cost-cutting and creating true client partnerships focused on innovation.
